a. Masa Percobaan adalah suatu periode maksimum 3 bulan pada waktu perusahaan mengadakan hubungan kerja waktu tak tertentu dengan karyawan di mana masing-masing pihak berhak sewaktu-waktu memutuskan hubungan kerjanya tanpa kewajiban untuk memberi alasannya dan tidak kewajiban memberi pesangon, penghargaan masa kerja dan ganti rugi lainnya.

 

b. Magang telah diatur dalam KepMenakertrans terlampir.

Sedikit menambahkan … yang dimaksud rekan Rudy mungkin adalah adanya kesepakatan kerja masa orientasi atau magang kerja setelah itu di kontrak.

Dalam PKWT tidak diperkenankan adanya masa percobaan. Saya baru nemu istilah masa kerja orientasi atau magang……. Kurang gaul nih saya…. jadi mau digauli biar tambah ok nih ilmu…

Cuma, dalam pikiran saya kenapa tidak di tempatkan di out sourcing terlebih dahulu baru setelah itu di kontrak. Kan lebih aman tuh….

Itu saja sih dari saya. Kurang lebih nya mohon maaf yang sebesar2nya.

Bilang saja masa probation, legal kok. Pengertian probation dan magang beda Pak setahu saya, dan impactnya ke perhitungan pajak juga beda.

Ditempat saya bekerja, kebijakan dan menjadi budaya perusahaan bahwa setiap orang yg baru masuk kerja harus melewati masa percobaan, setelah masa percobaan berakhir dievaluasi dan jika OK, baru kemudian dikontrak. Untuk menyiasati penyimpangan daripada implementasi ini terhadap UUTK maka kesepakatan kerja masa percobaan diganti menjadi kesepakatan kerja masa orientasi atau magang kerja.

 

Apakah praktik ini legal?
